Contributors retain all copyrights over any material they submit to be included. An exception may be when submitting textual content that requires future modification by others and if you want to talk about this we'll be happy to.
Simply put Luminous-Lint doesn't want to take any credit or claim legal ownership for your labors.
If the copyright of an item has expired it is in the public domain. Some organisations attempt to extend copyright by taking a photograph or a scan of the object thereby making a digital surrogate and claim fees based upon the copyright for that. As there is no creativity in this process it is treated the same as a "fact" and is not copyrightable in the same way that the fact "Abraham Lincoln was an American President" can not be copyrighted. This has been tested in America by the Bridgeman Art Library v. Corel Corp., 36 F. Supp. 2d 191 (S.D.N.Y. 1999) case and dismissed and subsequent jurisprudence has ruled that the cost and time of making the surrogates is not a consideration as it is a "slavish copy". International copyright law is not straight forward but attempts to extend copyright by creating digital surrogates without intervening creativity appears a dubious practise and goes against the requirements of art history and research.
Luminous-Lint does not pay for the right to use images that are out of copyright. It would pay if it required high-quality photographs or scans to be specifically created for Luminous-Lint or for specified research to be carried out. This situation has never arisen as the photohistory community overwhelmingly recognises and appreciates the non-commercial service provided by Luminous-Lint.
The intention of this site is to provide detailed information on photography to you but it can only do that if it is used appropriately and supported by you.
In the case that a photographer is having an issue with copyright on the Internet and seeks the advice of Luminous-Lint to assist we will do everything we reasonably can to help to publicize any cases of fraudulent use or misrepresentation. We will also put warnings on this site to alert buyers of potential issues as illegal use of images damages the entire photographic community.
